Standard Terms and Conditions
Learner Rider’s Declaration and Acknowledgement
Introduction
This declaration must be thoroughly read by all Sunshine Coast Motorcycle School (SCMS) students. By signing the Declaration and Acknowledgement (or clicking “Submit” if applying online), you acknowledge that you understand and will be bound by the conditions for undertaking SCMS’s training and assessment program contained in this declaration. You also acknowledge by signing (or clicking “Submit” if applying online) this declaration that any concerns about your health that could affect your safety have been raised by yourself and discussed with your Rider Trainer prior to training and/or assessment and that you are satisfied with the Rider Trainer’s responses.

Learner Rider’s Declaration and Acknowledgement
As a participant of SCMS’s motorbike training and assessment, I:

• Am eligible to participate in motorcycle training and have a valid, current class RE learners or RE if upgrading to an R license.
• Agree that SCMS may conduct ‘pre-Q-Ride’ training prior to a Q-Ride assessment.
• Agree to SCMS’s fees and charges for training and assessment.
• Agree to wear all safety gear (including a helmet) as presented and directed by my Rider Trainer.
• Agree to ride accompanied by the Trainer during on road training. In the event that I become separated from the Trainer, I will pull over on the left hand side of the road in a safe and legal place and wait for the Trainer to return.
• Agree to pull over on the left hand side of the road in a safe and legal place in the event of a breakdown and wait for the Trainer to return. The Trainer will return to provide support and assist as soon as possible.
• Agree to pay an excess of $500.00 for any damage caused by me to SCMS’s training motorbikes.
• Acknowledge that SCMS shall keep personal information pertaining to my training and assessment records. These records shall be kept in a safe and secure location. Learner’s personal details will comply with privacy principles. (This includes the copy taken of the learner’s licence).
• Will make a request directly to the Provider in writing if I wish to view my training records. The Provider shall be responsible for making a decision on the outcome of the application within 48 hours of receipt of the request.
• Have advised my Rider Trainer (and included details in the appropriate medical form) of all potential health issues which I know I have, including those that may require the consumption of prescription and other medication during the ride and I agree to allow the Rider Trainer to carry the necessary medication for me throughout the ride.
• Will not deliberately risk the safety of myself or any other participants participating in SCMS’s training and assessment.
• Have not consumed any illegal drugs or excessive alcohol within 24 hours of the ride.
• Have entered SCMS’s premises at my own risk and acknowledge and agree that I will participate in the SCMS’s training and assessment at my own risk.
• Have been offered the opportunity to ask any questions of SCMS and have had any questions answered to my satisfaction.
• Have entered this agreement and decided to participate in SCMS’s training and assessment freely and not under any duress.
• During the training I will not ride a motorcycle in any manner that contravenes any law.
• I will inform the trainer if any exercise I have been asked to perform is not within my current ability to perform at a safe standard.

I also acknowledge that I have read, and agree to be bound by, the Standard Terms and Conditions of SCMS. In particular, I (the Rider) agree that:
• SCMS has the right to refuse my participation in SCMS’s training and assessment if there is justified concern for the safety of myself or other persons.
• I will respect and obey the safety directions and instructions given by my Rider Trainer and all other representatives of SCMS.
• I participate in SCMS’s training and assessment at my sole risk.
• My participation in SCMS’s training and assessment is on the basis that:
 all statutory or implied conditions and warranties are excluded to the extent permitted by law; and
 all and any liability on the party of SCMS is excluded.
• I release SCMS and its officers, employees and agents from:
 all claims, demands, proceedings of every kind;
 all loss or damage (including but not limited to property or death or personal injury of any nature or kind);
 any liabilities whatsoever (including, but not limited to, negligence); and
 all reasonable costs and expenses.
• I shall indemnify and keep indemnified SCMS and their officers, employees and agents against all claims, demands, proceedings, loss, costs, charges, legal fees, expenses, damage and liability whatsoever for which SCMS shall or may be or become either totally or partially liable in respect of or arising from loss, damage, injury or death from any cause (accidental or otherwise) to property or person occasioned or contributed to by my acts, omissions, neglect, breach or default.
• I provide this indemnity notwithstanding that any of such actions, claims, demands, losses, damages, proceedings, compensation, cost, charges, and expenses shall have resulted from any act or thing which I may be authorized or obliged to do.

Cancellations and Rescheduling of Appointments
• Normal processing time for a refund request is up to two weeks.
• Confidentiality of student information will be ensured.
• In the event of a course for which the student was enrolled being unavailable or no acceptable alternative course is available, fees are fully refundable to the student.
• If you fail to attend a day that you have been booked in for, there will be no refund or rescheduling. Weather conditions, work requirements, motorcycle problems etc are not the organizers responsibility and as such, riders who do not attend will forfeit their monies.
• Credits or reschedules are at the discretion of the organizer and if given, must be used within 6 months of the event date.

Lesson specific cancellation information:
• 48 hours notice is required, otherwise the lesson will be forfeited with no refund unless dire emergency or illness.

Q-Ride specific cancellation information:
• A $150 deposit is required to secure your booking.
• The deposit will not be refunded if you cancel. If you cancel you can request a refund, less the deposit, or you can reschedule.
• If you reschedule with less than 7 days notice, a new deposit will be required.

NOTE: Please do not assume your booking is secure if you have not paid your deposit.

NOTE: If we deem you or your bike unfit to ride, or if you choose to ride only part of the day, your balance of your monies will be forfeited.
